1. Applicability of special terms #

1. These special terms apply to your ordering and/or use of Data Middle Platform products and services from Volcano Engine (“the Service”). The specific content of the Service is subject to the Data Middle Platform section under Products–Intelligent Platform–Data Middle Platform on the Volcano Engine official website. If there are special provisions in these special terms, these special terms shall apply. These special terms do not apply to Intelligent Data Insight.
2. Once you order or use the Service, these special terms, together with (1) the “Volcano Engine Service Terms” and “Volcano Engine Privacy Policy” published on the Volcano Engine official website, (2) “Product and Service Agreement”, (3) ordering agreement/service order, (4) Service Level Agreement (if any), and (5) other applicable agreements such as service rules, collectively constitute the complete agreement between you and Volcano Engine regarding the ordering and/or use of the Service.
3. For matters not expressly stipulated in these special terms, the provisions of other applicable agreements or service rules entered into between you and Volcano Engine shall apply.

2. Rules for using the service #

1. You must use your legally registered Volcano Engine official website account to log in to the Volcano Engine official website and use the Service through the website console. If you use access keys for API and/or online SDK, you must follow the usage instructions to use the Service. You are responsible for the integrity and confidentiality of the keys and must take appropriate security measures (including but not limited to access permission management and key encryption).
2. You are solely responsible for all uses of model output content and for independently evaluating the accuracy, legality, and appropriateness of model outputs in specific use cases and scenarios. You (including your users) must not use models to create content that infringes upon the legitimate rights and interests of third parties (including but not limited to intellectual property rights, portrait rights, voice rights, reputation rights, and more). If your failure to fulfill these obligations causes any loss to Volcano Engine or leads to related disputes, you shall bear sole responsibility and compensate Volcano Engine for any resulting losses.
3. (If applicable) To facilitate your creation and experience, the platform provides several AI-generated materials, including a virtual portrait library and other materials (collectively referred to as "Reference Materials"), which you may choose to use. Without the written consent of Volcano Engine, you may not copy, download, compile, distribute, or sell the Reference Materials, use the Reference Materials outside the Volcano Engine platform and services, or use the Reference Materials for purposes that compete with Volcano Engine products and services (including developing or forming similar material libraries). You acknowledge and confirm that, although we have fully considered diversity when generating virtual portraits and other materials through artificial intelligence, there may still be differences due to region and culture. If you find that the Reference Materials lack the region, gender, age, occupation, ethnicity, skin color, or other elements required for your business when using them as a reference, you may provide suggestions to us.
4. (If applicable) The video generation model can accept images, videos, and audio as part of the service input ("Visual Function"), and you may upload your own materials ("Custom Materials") for video content generation and optimization. You represent and warrant that any custom materials you upload are content for which you legally own the intellectual property rights or have obtained full and lawful authorization from the relevant rights holders. Your use of custom materials in the model service, as well as any content subsequently generated by the model based on your custom materials, will not infringe upon any third party's lawful rights and interests (including but not limited to copyright and other intellectual property rights, portrait rights, voice rights, and more). You further confirm that the custom materials are original works of yours or the relevant rights holders and do not contain any content that infringes upon the lawful rights and interests of any third party. You must not use visual features to assist in identifying personal identities, nor use such features to obtain or infer personal privacy or sensitive information. Without the explicit consent of the relevant individuals and without obtaining all necessary rights, you must not use visual features to reproduce or generate any person's portrait or voice. If you choose to publicly share images or videos generated by the model through any channel or in any form (for example, sharing on social media, content platforms, creating virtual avatars, and more), this indicates that you have obtained all necessary rights related to the generated content, and you agree to grant Volcano Engine the rights to reproduce, distribute, modify, display, and use such content for the operation of the service. If you are unable to confirm the rights status of the custom materials, do not upload them or use them in the model service. You shall bear full responsibility for any resulting infringement and consequences. Uploading materials with unclear ownership, defective rights, or infringing content also constitutes inducement and misuse of the model. Volcano Engine reserves the right to hold you liable for breach of contract. If this causes Volcano Engine to be held liable by a third party, Volcano Engine has the right to seek full compensation from you for all resulting losses.
5. (If applicable) If your custom assets include real person portrait materials, you must obtain authorization from the rights holder themself. Please contact Volcano Engine and provide the relevant supporting documents, or use the real person material upload feature after completing certification through the authentication tool provided by Volcano Engine. You must ensure that you have obtained full authorization and consent from the certified natural person, and you are obligated to take security measures to store and protect the personal information (including sensitive personal information) collected by the authentication tool issued through the account you manage. Volcano Engine reserves the right to decide, at its sole discretion and based on the supporting documents you provide, whether to enable this feature for you. Special reminder: The review and authentication technologies are preliminary and cannot guarantee the absence of defects. Passing the review and authentication does not constitute a substantive confirmation by Volcano Engine of the compliance of your materials and their use, does not mean that your use of others' real person portrait and voice materials will not infringe upon the corresponding rights of the rights holder, nor does it exempt you from compliance obligations. Before uploading or using any materials involving others' portraits and voices, you must still ensure that you have obtained the rights holder's legal and sufficient authorization, and you remain solely responsible for the use of the relevant materials. If the use of such materials causes losses to Volcano Engine or results in claims by third parties, you are still required to compensate Volcano Engine. If you upload a virtual portrait that is highly similar to a real person portrait, it may also fail to be uploaded to custom assets.
6. You understand and agree that all Volcano Engine services are performed automatically by technical tools. Unless otherwise agreed in writing and/or for the performance of special obligations under the service agreement (such as troubleshooting or detection in applicable scenarios), Volcano Engine does not provide manual intervention in the service process or results.
7. The Volcano Engine services are limited to your own use for your products in accordance with the provisions of the service agreement. You understand and agree that if you use this service for commercial purposes or otherwise obtain direct or indirect benefits, you must obtain prior written permission from Volcano Engine. If you use, transfer, sublicense, or lease any resources, technical support, or services provided to you by Volcano Engine beyond the scope of authorization (including transferring, sublicensing, or leasing to your affiliates), Volcano Engine has the right to immediately terminate the aforementioned license. You shall bear any resulting losses and consequences, and Volcano Engine shall not be liable for them.
8. You use this service to process personal information and data that you have lawfully collected. The data processing results obtained through this service are provided directly to you and may only be downloaded, accessed, and processed by you.
9. You agree to comply with the Volcano Engine Information and Network Security Rules ("Security Rules"). If you violate the Security Rules or any provision of this agreement, including but not limited to failing to possess all required qualifications and permits to conduct business at the time of signing this agreement, failing to complete relevant procedures, or losing all or part of such qualifications or permits during the term of this agreement, Volcano Engine has the right to suspend the provision of services and require you to rectify the situation within a specified period. If you fail to rectify within the specified period, Volcano Engine has the right to terminate this agreement, require you to bear liability for breach of contract, and compensate Volcano Engine for corresponding losses.
10. You have the right to configure the operating environment of your products through the Volcano Engine platform, control the deployment of your products, and are solely responsible for the components above the operating system (including system-installed software and programs). Volcano Engine is only responsible for the underlying components below the operating system and for the operation and maintenance of the software and services provided by Volcano Engine. If you upgrade the system, install software, or applications on your own, this may result in potential adverse effects such as downtime or data loss. You are responsible for confirming the risks in advance and proceeding with caution. Volcano Engine does not assume liability for these matters for which you are responsible.
11. Unless otherwise agreed in writing by both parties, you must not occupy a large amount of, nor cause programs or processes to occupy a large amount of, server memory, CPU, or network bandwidth resources within Volcano Engine's cloud computing resources. You must not impose a significant load on the Volcano Engine platform, or on the networks, servers (including but not limited to local, remote, and international networks and servers), products, or services of other Volcano Engine users. Such actions must not affect the smooth connectivity of Volcano Engine's cloud computing resources and networks with the Internet, with specific networks or servers, or with the internal network of the Volcano Engine platform. You must also not cause the servers providing the Volcano Engine platform services or those used by other Volcano Engine users to be down, crash, or make products or services based on the Volcano Engine platform inaccessible to users.

Instructions for service trial #

1. Volcano Engine may provide you with free services by invitation, through public beta, or within a certain usage quota. The specific free trial period or quota is subject to the information published on the official Volcano Engine website. During the free period or within the free quota, you are not required to pay any fees. Volcano Engine does not rule out the possibility of charging fees in the future. At that time, Volcano Engine will announce the charging policy and terms in advance by publishing an announcement on an appropriate section of the website or by sending an in-site notification. If you continue to use the relevant services after the charging period begins, you must pay for the subsequent use of the products or services according to the then-effective charging policy. The specific terms shall be subject to the public announcement on the official Volcano Engine website or the provisions of the 'Product and Service Testing Agreement' (if any) signed between you and Volcano Engine.
2. During the free trial period, Volcano Engine will provide support for service availability and reliability, but does not make any commitments regarding service availability or reliability. The 'Service Level Agreement' will apply after you start using the official release version of the products and services.
