## 1. Applicability of Specific Terms 1.1 These Specific Terms apply to your order and/or use of the **Network Products and Services** (the "Service") provided by VolcanoEngine. The definitive list of the Service is as set forth on the VolcanoEngine official website under All Services \- Network. In the event of any conflict, these Specific Terms shall prevail. 1.2 Upon your order and/or use of the Service, these Specific Terms, together with (1) the [VolcanoEngine Service Terms](https://www.volcengine.com/docs/6256/64903) and the [VolcanoEngine Privacy Policy](https://www.volcengine.com/docs/6256/64902) as published on the VolcanoEngine official website, (2) the [Product and Service Agreement](https://www.volcengine.com/docs/6256/68938), (3) the Order Terms/Service Order, (4) the Service Level Agreement (if any), and (5) other applicable agreements and service rules, shall constitute the entire agreement between you and VolcanoEngine regarding the order and/or use of the Service. 1.3 For matters not expressly stipulated herein, the provisions of other applicable agreements or service rules entered into between you and VolcanoEngine shall govern. ## 2. Rules of Service Use 2.1 In accordance with relevant telecommunications regulations, the Service is intended for your own use. If you provide, whether directly or indirectly, the Service in whole or in part to any third party, or permit any third party to use the Service under this Agreement, whether for a fee or not, VolcanoEngine shall have the right to terminate the provision of the Service. 2.2 You shall not excessively occupy, or cause programs or processes to excessively occupy, server memory, CPU, or network bandwidth resources within VolcanoEngine's cloud computing infrastructure. Such actions shall not impose a severe load on VolcanoEngine's or other VolcanoEngine users' networks, servers (including but not limited to local, remote, and international networks and servers), products, or services, impair the smooth operation between VolcanoEngine's cloud computing resources and networks, or cause server downtime, crashes for VolcanoEngine or other VolcanoEngine users, or render products or services based on the VolcanoEngine platform inaccessible. 2.3 You agree that when you select a pay\-as\-you\-go (by traffic) service, you shall use traffic within the conventional peak bandwidth specified by VolcanoEngine (even if you have paid for the traffic). If your peak bandwidth usage exceeds such conventional limits, VolcanoEngine reserves the right, at its reasonable discretion, to throttle your traffic or peak bandwidth, or suspend the Service. You shall bear all direct or indirect losses arising therefrom. VolcanoEngine will lift the corresponding restrictions if both parties separately agree on payment for the excess portion. 2.4 **If your business requires handling large\-scale, sudden traffic spikes (i.e., a burst increase equal to or greater than 30% of the billed traffic from the previous month), you must notify VolcanoEngine in writing at least 3 working days in advance and obtain VolcanoEngine's written confirmation. Otherwise, VolcanoEngine shall not be liable for any impact on service availability caused thereby.** 2.5 **Pursuant to relevant regulations, access service providers are prohibited from providing access services for unregistered domains. Filing information and domain registration information must be authentic and accurate. If you violate laws and regulations related to filing, VolcanoEngine shall have the right to disconnect your website and shall not be liable for the resulting service interruption.** ## 3. Rights and Obligations of VolcanoEngine 3.1 During the Service Term, VolcanoEngine shall provide the Service in accordance with the applicable Service Level Agreement and shall provide you with service credits for any failure to meet the service availability standards. Such service credits constitute your sole and exclusive remedy for any breach under this Agreement. 3.2 VolcanoEngine is only responsible for the operation and maintenance of the underlying infrastructure below the operating system level and the software provided by VolcanoEngine. You are responsible for all components above the operating system (e.g., applications you install). Furthermore, you acknowledge that operating system upgrades performed by you may cause adverse effects such as system downtime. You shall assess the risks and proceed with caution. 3.3 **VolcanoEngine shall establish (and shall continuously improve in line with technological advancements) necessary technical measures to defend against activities or acts harmful to network security, including computer viruses, network intrusions, and attack disruptions (including DDoS) ("Network Hazard Activities"). However, given the evolution of network security technology and the unpredictability of network attacks, if Network Hazard Activities against your website cause harm to VolcanoEngine or VolcanoEngine's other networks or servers (including local and remote networks, servers, etc.), or impair the connectivity between VolcanoEngine and specific networks, servers, or internal networks, VolcanoEngine may decide to suspend or terminate the Service.** **If VolcanoEngine terminates the Service, fees will be calculated based on the actual months of service provided (prorated on a daily basis for periods less than a month), and any remaining prepaid amount (if any) will be refunded.** **VolcanoEngine shall not be liable for any impact on service availability caused by Network Hazard Activities.** 3.4 **VolcanoEngine may, based on product development plans, modify, adjust, or enhance one or more features of the Service and provide you with updated versions. To optimize user experience and service quality, you shall cooperate with VolcanoEngine to complete version upgrades.** **Upon providing appropriate notice, VolcanoEngine reserves the right to terminate one or more service types within the Service at any time.** **Modifications, adjustments, or enhancements to features may not be provided free of charge. If corresponding fees are incurred, VolcanoEngine shall notify you in a reasonable manner. You may cease using the Service if you do not agree to bear such fees.** 3.5 You understand and acknowledge that VolcanoEngine will provide you with certain security protections, management, and monitoring functions and services (e.g., "Cloud Monitor"). However, VolcanoEngine cannot guarantee complete compatibility with all software and hardware systems, nor absolute accuracy of the software and services. In the event of incompatibility or software errors, you shall immediately disable or cease using the related functions and promptly contact VolcanoEngine for technical support. ## 4. Service Trial Usage 4.1 VolcanoEngine may provide you with free services for a limited period and/or within a specified quota through methods such as beta or public preview, as detailed in the information published by VolcanoEngine. During the free period and/or within the free quota, you are not required to pay any fees. However, VolcanoEngine reserves the right to charge fees in the future. In such an event, VolcanoEngine will announce the fee policy and specifications in advance via a notice posted in a suitable section of the website or by sending an internal notification. If you continue to use the corresponding services after the commencement of the fee\-charging period, you shall pay for the continued use of the products/services according to the then\-effective fee policy. 4.2 During the trial period, VolcanoEngine will provide technical support for service availability and reliability but makes no commitments regarding any specific level of service availability or reliability. The Service Level Agreement shall become applicable upon your activation and use of the officially released version of the product/service. 4.3 If you use chargeable services (e.g., Elastic Compute Service) while using free services (e.g., Virtual Private Cloud), you shall pay for such chargeable services in accordance with their applicable billing rules, even if the underlying services are free. ## 5. Special Terms for Direct Connect 5.1 VolcanoEngine Direct Connect is designed to establish a high\-speed, low\-latency, stable, and secure private network connection between your on\-premises data center and the Virtual Private Cloud (VPC), supporting interconnectivity between multiple on\-premises data centers and multiple VPCs. You shall ensure that the entity constructing the physical line connected to VolcanoEngine possesses the Domestic Communication Facility Services [A26] and Internet Data Transmission Services [A14] licenses issued by the Ministry of Industry and Information Technology (MIIT) of the People's Republic of China, or has obtained the relevant approval documents, and conducts the related data transmission business within the business coverage area and permissible geographical scope specified in such approval documents. If you use non\-compliant physical lines, you may face risks such as being ordered by relevant authorities to cease construction or transmission services. You shall bear all corresponding risks and consequences arising therefrom, and VolcanoEngine shall not be liable in this regard. 5.2 The service term for VolcanoEngine Direct Connect ranges from [**1**] month to [**3**] years. You may select the commitment period based on your actual business needs. You are specifically advised that if you choose a commitment period but need to terminate the service before its expiry, you are required to pay the full fee for the remaining service period. The remaining service period is calculated as follows: Remaining service period = Committed service duration − Period from the initial service activation date to the early termination date. ## Previous Versions of Network Product Service Terms [Network Product Service Terms (October 8, 2022)](https://www.volcengine.com/docs/6402/75280?TimeBefore=1665212193) [Network Product Service Terms (April 28, 2022)](https://www.volcengine.com/docs/6402/75280?TimeBefore=1651100746) [Network Product Service Terms (March 1, 2022)](https://www.volcengine.com/docs/6402/75280?TimeBefore=1646097126) [Network Product Service Terms (November 20, 2021)](https://www.volcengine.com/docs/6402/75280?TimeBefore=1637735528)
